The residual category still has rules
A product outside the toy, electrical, cosmetic and food-contact regimes is not automatically unregulated. General product safety law requires that it is safe in normal use, that it can be traced, and that the seller can act if a problem appears. In the EU, GPSR adds the responsible person and the traceability details.
Chemical restrictions can still apply through REACH or a state warning law, especially for coatings, plastics and imported materials. The supplier declaration is the starting point, not the end of the analysis.
Traceability is the cheap insurance
Batch or serial identification, supplier records and a clear link between the label and the manufacturer make a recall possible and a complaint answerable. The cost is small compared with the cost of not being able to identify which shipment is affected.
For a small seller, the practical file is a product specification, a supplier declaration, the label artwork and the responsible-person details. It does not need to be elaborate, but it does need to exist and to match the goods being sold.
Frequently asked questions
Do I need a test report for a simple consumer product?
Not always. The requirement follows the product and the market. General safety law can be satisfied with a risk assessment and supplier evidence, but specific categories have mandatory tests.
Does GPSR apply to every product sold in the EU?
It applies to consumer products within its scope, with exclusions for certain product groups that have their own regimes. The responsible-person requirement is the practical first check.
Is a supplier declaration enough for REACH?
It is evidence, not a guarantee. For higher-risk materials, test data is the stronger file, and the buyer remains responsible for the product placed on the market.
